VAWA / Special Victim Visas

VAWA (Violence Against Women Act)

I have been physically or mentally abused by my U.S. citizen/LPR spouse or parent, but I don’t have any legal status. Is there anything I can do?

This visa allows for spouses and children who have been abused by U.S. citizen or Lawful Permanent Resident spouses or parents in the U.S. to self petition and obtain lawful permanent resident status on their own. Wether you entered the U.S. undocumented or are a conditional resident, you may be eligible to self-petition and become a lawful permanent resident. You may also self petition if you are no longer married to the abuser, but you must apply prior to remarriage. Special Victims (U-Visas)

I was the victim of a crime which I reported to the police. Will I be deported because the police have my name?

NO, the U visa allows for VICTIMS of serious crimes committed in the U.S. and their family members to petition for a temporary 4 year visa. At the end of that time period you may also be eligible to become a Lawful Permanent Resident. You may be eligible even if you are not in the U.S., have a criminal background, or even if you have a prior order of removal.
